Favorable opinion of the Court of Appeal of Paris for two extraditions

This Wednesday, November 13, 2013 could be a historic day in regard to the extradition to Rwanda. Chamber of instruction of the Court of Appeal of Paris has just given a favorable opinion on the extraditon of Claude Muhayimana and Innocent Musabyimana to Rwanda, following the opinion of the prosecutor. This is not the first time that the Court of Appeal rules for extradition, but this is a first for the Court of Appeal of Paris. The President was however careful after announcing that it was a favorable part, thereby excluding “ordinary crimes ” that the defense could of course turn to the Supreme Court to annul such a decision. That will not fail to Master Meilhac, the lawyer for the two alleged genocidaires. We must therefore expect the position of the Court of Cassation, which has four months to give its opinion. Will this position be different from other decisions? Difficult to say today. Until now, the court has always broken decisions in favor of extradition. We must content ourselves with the positive decison that day and greet the evolution of judges of the Court of Appeal of Paris. We also look forward to a decison of the Supreme Court regarding Laurent Serubuga, as the Parquet de Douai has appealed the refusal of the Court of Appeal to extradite former deputy state of the former army chief staff Rwandan. As we approach the twentieth commemoration of the Tutsi genocide, the lines seem to move. But we will not be completely reassured but when extradition is actually delivered. In the meantime, all our energy should be put at the service of the first seating trial to be held in Paris from February 4 to March 28 against Pascal Simbikangwa. The success of this trial may depend holding many other trials insofar as more than twenty-five complaints are under instruction at TGI de Paris ” crimes against humanity pole .”
